Nintendo, currently forecasting 2024 net sales of $8.4 billion and operating profits of $2.4 billion, continues its furious hearing on those moderating or emulating its systems and games. The move is intended to reference the shutdown of Modded Hardware, the site that Archbox was allegedly associated with, by identifying all other people involved. To do this, Nintendo is asking for access to information held on the subreddit’s 200,000 members.

In almost all of these features, Defendent ran as “Archbox” or a close variant of that name…
During our investigation, we also learned of a number of other online entities that likely played a role in the pirate shops. However, we were unable to determine the location of these other entities with sufficient certainty to name them in the original complaint. Accordingly, NOA did not include these individuals in the lawsuit…expecting that mere discovery…would reveal the identities and locations of these entities.
However, because Williams allegedly evaded Nintendo’s attempts to serve him and then failed to appear in court, Nintendo argues in its filing that this meant it was unable to find these identities through discovery, and Nintendo is therefore seeking subpoenas to court. Nintendo is asking Google for access to Google Drive and Gmail data, but is not specific about its intentions regarding Discord, and the situation with Reddit is detailed as follows:
Reddit, Inc. operates a social media platform where users, often using pseudonyms, can post to various forums called communities or “subreddits”. Defendant was the primary moderator of the SwitchPirates community called “Archbox”, which had over 190,000 members. Nintendo has reason to believe that other accounts vigorous in the SwitchPirates community may also have been controlled by the Defendant or reflect other individuals who worked with the Defendant.
Nintendo Switch is the third most successful console in history, with 146 million consoles currently sold. It looks like the second console with sales of 154 million, the Nintendo DS, will take the second position next year.
